Discovery - Document Review - Foreign Documents

Not every litigation, arbitration or prosecution has the luxury that potential relevant documents will be in English.  Moreover, if you are a U.S. based company with foreign subsidiaries or an entity not based in the United States looking at litigating your dispute in the United States, you will be subject to United States discovery procedures.  Being prepared for U.S. discovery requires a preliminary analysis before engaging the adverse party.

As disputes become more transnational, so does the complexity of reviewing the evidence.  Circonlex can provide your litigation team with attorneys and paralegals who are capable of managing and carrying out document review as well as reviewing those documents which are not in English but may be relevant to your client's case.  For entities located abroad we can help you along with your local and United States counsel to organize and assess your document strategy in the context of a U.S. Federal Rules of Civil Procedure Rule 26 obligation.

This aspect is particularly applicable in the rising number of FCPA prosecutions, international contract disputes, international arbitration as well as patent and copyright infringement.

Circonlex provides three essential services in this arena: First, we can help you estimate the potential cost of the discovery/pre-arbitral process in order to better understand the overall value of the underlying claims.  Second, we supply or supplement existing legal teams during the discovery and pre-trial process to ensure that your English and foreign language documents have been properly identified and preserved and, if necessary, translated.  Third, we have experience managing the document review process so that your legal team can focus on production and building a case instead of spending countless hours supervising outside consultants.  Circonlex is personally involved in the process, we do not merely provide contract legal professionals.

In addition to assisting you during the document review process, Circonlex will simultaneously  translate those foreign language documents that have been identified as relevant and to be produced or, conversely, relevant documents that have been delivered pursuant to a discovery request. Circonlex can also certify the accuracy of the translation should you so require.

Circonlex has United States state bar qualified lawyers available within short notice to take care of your document review needs in :
