As reported by the Legal Times blog, the DOJ intends to pursue FCPA investigations in the pharmaceutical business area. As FCPA investigations often involve foreign documents such as e-mails, contracts and other paper trails the review of this evidence is rendered more complicated.
The question for the pharmaceutical companies is whether they have taken the necessary steps to independently interview any persons of interest and performed a sufficient and thorough audit of any potential relevant evidence.
